María Luisa Mendoza, Associate in our International Trade and Customs and Life Sciences practice groups wrote the article: “Reasonableness and Food Advertising: A View from Mexico” which has been included in the most recent edition of the Update Magazine, edited by the Food and Drug Law Institute (FDLI).
The article addresses the challenges that the food and beverages industry must face in the compliance with legal provisions related with labeling and advertising, specifically those arising from the local administrative criteria being enforced by Mexican Health authorities.
Additionally, it is a compared study of the U.S. standards where the courts analyzed the application of the First Amendment (freedom of speech) to food and beverage labeling and advertising with the slow progress of such matters in Mexican administrative and judicial interpretation.
