Draft Resolution on Qualified Users Registry’s Regulation

On June 27th, the National Commission for Regulatory Improvement (“CONAMER”) published the preliminary draft of the “Resolution of the Energy Regulatory Commission issuing the General Administrative Provisions for registration in the Qualified Users Registry and its operation and functions” (the “Resolution”).

The purpose of the Resolution is to establish the rules for the administration, operation, and functioning of the Qualified Users Registry (“Registry”), and to establish the terms for the i) registration; ii) the application form; iii) the reception; and iv) submission of applications, legal documents and communications corresponding to the processes and actions related to the activities of Qualified Users.

In addition, the Resolution is intended to be a regulatory instrument that allows current Qualified Users to have applicable rules and criteria for various processes such as application, update or modification of their registration, as well as the unbundling of load points, through an updated platform that allows the number of registered Qualified Users to increase and, consequently, the increase in demand for Qualified Supply.

Therefore, the electronic platform of the Registry will be designed to collect operational information and general data from individuals and entities included in the Registry.

The Resolution repeals the general administrative provisions previously applicable in the matter, issued through Resolution RES/2506/2017 (published December 6th, 2017).

The Resolution has been classified with a High Regulatory Impact. Consequently, it will follow the ordinary process and deadline for assessment, and comments can be made during the public consultation.
