General Administrative Provisions in Electromobility Matters

As a follow-up to our newsletter published on February 26, 2024, regarding the regulation of electromobility matters in Mexico (Draft of General Administrative Provisions in Electromobility Matters), on September 10, the "Decree No. A/108/2024 by which the Energy Regulatory Commission issues the General Administrative Provisions regarding Electromobility for the integration of Electric Vehicles and Connectable Hybrid Electric Vehicles charging infrastructure into the National Electric System as part of a Smart Grid" (the "Resolution") was published in the Official Gazette of the Federation.

The Resolution constitutes the first regulation issued in Mexico that specifically addresses electromobility matters. In particular, the Resolution introduces to our legal system a regulatory framework that develops various elements related to electric vehicles, such as the request for electricity supply service and charging infrastructure connection, the assembly and signaling of charging stations, the evolution and monitoring of the infrastructure, as well as the responsibilities of users and operators.

The Resolution also introduces and regulates concepts such as Electro-stations, free charging stations, and battery exchange stations.

The Resolution will come into effect on September 11, 2024.
