The Energy Regulatory Commission (the “Commission”) published on the Draft Projects portal of the Regulatory Improvement Commission (CONAMER) on November 10, 2023, Resolution No. A/0nn/2023 of the Energy Regulatory Commission establishing the use of the technological feature called ‘Energeocre’ to provide free information to individuals interested in carrying out regulated activities; and within this agency, to have an additional element for analysis and evaluation in the exercise of its powers in the granting of permits for public sale in service stations for petroleum and LPG, as well as in procedures related to supervision and administrative sanction procedures (the “Regulatory Project”).
The technological feature EnerGeoCRE will provide free information to those interested in carrying out regulated activities. In the initial stage, it will focus on activities involving the public sale of petroleum products and LPG, but later, other regulated activities may be included.
The objective of the Regulatory Project is to support interested parties and permit applicants by providing information about the location’s condition in relation to its surroundings and facilitating the development of business plans. Additionally, it will strengthen the internal processes of the Commission by identifying the location’s condition in terms of coverage opportunity, stability, or saturation.
EnerGeoCRE will be available for public consultation on the Commission's website, specifically in the section on activities for the sale of specific purposes for petroleum products (gasoline, diesel, or liquefied petroleum gas), starting from the effective date of the agreement, once published on the Federal Official Gazette.
The methodological clarifications regarding the application of EnerGeoCRE will be published on the Commission's website when necessary due to technical characteristics.
We consider that the implementation of this feature could be an attempt to expedite procedures and the issuance of permits by the Commission, which, in turn, may help alleviate the backlog of permits that the CRE has been experiencing for some time.
